DMCA Policy

Digital Millennium Copyright Act Compliance

1. Copyright Policy

Prism Writing LLC respects the intellectual property rights of others and expects our users to do the same. In accordance with the Digital Millennium Copyright Act (DMCA), we will respond to properly submitted notices of alleged copyright infringement.

3. Filing a DMCA Notice

If you believe that your copyrighted work has been copied in a way that constitutes copyright infringement, please provide our DMCA Agent with the following information:

  • Identification of the copyrighted work: A description of the copyrighted work you claim has been infringed, or if multiple works, a representative list
  • Identification of the infringing material: A description of where the allegedly infringing material is located on our website (please include URLs)
  • Contact information: Your name, address, telephone number, and email address
  • Good faith statement: A statement that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law
  • Accuracy statement: A statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the owner's behalf
  • Physical or electronic signature: Your physical or electronic signature

4. Counter-Notification

If you believe that material you posted was removed or access to it was disabled by mistake or misidentification, you may file a counter-notification with our DMCA Agent containing:

  • Identification of the material that has been removed or disabled and the location where it appeared before removal
  • A statement, under penalty of perjury, that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification
  • Your name, address, telephone number, and email address
  • A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or the District of Arizona if outside the U.S.)
  • A statement that you will accept service of process from the person who provided the original DMCA notification
  • Your physical or electronic signature

5. Repeat Infringer Policy

In accordance with the DMCA and other applicable laws, Prism Writing LLC has adopted a policy of terminating, in appropriate circumstances and at our sole discretion, users who are deemed to be repeat infringers. We may also limit access to our website and/or terminate accounts of any users who infringe any intellectual property rights of others, whether or not there is any repeat infringement.

6. False Claims

Under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material or activity is infringing, or that material or activity was removed or disabled by mistake or misidentification, may be subject to liability for damages.

7. Response Timeline

Upon receipt of a valid DMCA notice:

  • We will acknowledge receipt within 1 business day
  • We will remove or disable access to the allegedly infringing material within 1-2 business days
  • We will notify the user who posted the material
  • If a counter-notification is received, we will forward it to the original complainant
  • If no counter-notification is received within 10 business days, the material will remain removed

8. Fair Use Consideration

Before submitting a DMCA notice, please consider whether the use of copyrighted material qualifies as "fair use" under U.S. copyright law. Fair use is a legal doctrine that permits limited use of copyrighted material without permission for purposes such as:

  • Criticism and commentary
  • News reporting
  • Teaching and education
  • Research and scholarship

Prism Writing LLC primarily publishes educational, analytical, and commentary content that often qualifies as fair use under 17 U.S.C. § 107.
